A. Three Music Website Terms of Use

1. General

These are the terms and conditions (“Site Terms”) which apply to the use of this Site by you, the end user. By accessing and use of this Site, you agree to be bound by them and the terms of the Privacy Policy (set out below) and are deemed to have accepted them. This Site is intended for the benefit of UK residents who are 18+.

We may update or amend the Site Terms at any time, and your continued use of this Site after any change to them constitutes acceptance by you of them. Please ensure that you regularly check back to this section to ensure that you understand the terms that apply at any particular time.

If you cannot or are unable to agree to any of the Site Terms and/or the Privacy Policy, please do not use this Site.

2. About this Site

2.1 This Site is created to host festival related information, content, activity & promotions in relation to Three UK’s partnership with Live Nation.

2.2 You are responsible for ensuring that all persons who access this Site through your internet connection are aware of the Site Terms and comply with them.

2.3 The content on this Site is provided for general information only and is not intended to amount to advice on which you should rely.You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on this Site.

2.4 Although we make reasonable efforts to update the information on this Site, we make no representations, warranties or guarantees, whether express or implied, that the content on this Site is accurate, complete or up to date.

2.5 We reserve our rights to modify update, amend, withdraw or suspend any feature, functionality, material or content on the Site at any time without notice to you.

3.Intellectual Property

3.1 We are the owner or the licensee of any and all intellectual property rights in the Site and the material and any content published or made available on it.

3.2 We grant to you a limited licence to print off one copy (and to download extracts) of any page(s) from the Site for your personal use only.Any other use of the content of the Site is strictly prohibited. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

3.3 Our status (and that of any identified contributors) as the authors of content on this Site must always be acknowledged (except where the content is user generated).

3.4 You must not use any part of the content on the Site for commercial purposes without first obtaining a written license to do so from us or our licensors.

4. User Generated Content

4.1 We may now, or in the future, allow submission (upload/post) to this Site by you or others of user generated content such as videos, written commentary and/or still photography (together, “UGC”).

4.2 If you decide to make use of such a feature, you confirm the following:

The UGC is:

  • your own, original work or is licensed to you by the owner of the rights;
  • it does not contain material that could incite a terrorist offence, solicit any person to participate in terrorist activities, provide instruction on any method or technique for committing a terrorist offence or threaten to commit a terrorist offence;
  • it does not contain material that is illegal, immoral, discriminatory, or of a violent, pornographic or sexual nature;
  • is not indecent, defamatory, libelous, threatening or harassing (or of a nature that could be reasonably perceived to be so);
  • it does not infringe a third party’s rights;
  • does not or will not introduce any computer virus, trojan horse, worm, logic bomb or anything designed to interfere with, interrupt or disrupt the normal operating procedures of a computer.

4.3 You warrant and undertake that any such UGC does comply with the above points set out in section 4.2 above and you shall be liable and indemnify us on demand for any loss or damage we may suffer in connection with any breach of such warranty and undertaking.

4.4 Any UGC you upload to the Site will be considered non-confidential and non-proprietary. You shall retain all of your ownership rights in your original created content and shall grant to us an irrevocable, perpetual, non-exclusive, transferable, royalty-free, world-wide license (with the right to grant sub-licenses) to use the UGC, including but not limited to: modify, host, store, publicly display, reformat, excerpt (in whole or in part), and to distribute and make it available to third parties. If you cannot agree to this license, please do not upload or submit any UGC.

4.5 We do not endorse any UGC or any opinion, recommendation or advice expressed within it, nor are we responsible for any of its content including in relation to accuracy, security, safety, lawfulness or any other matter. We shall have the right to remove any UGC without notice to you if, in our reasonable opinion, it breaches or is likely to breach the above requirements. 5.Privacy

5.1 Your personal data is important to us and we, and our third party provider, NeverBland, will process any personal data we collect from you via this Site in accordance with our Privacy Policy (see section B below).

6.Third party websites

6.1 We may provide hyperlinks to other websites on the Site. We are not responsible for and do not endorse, guarantee or vouch (either directly or indirectly) for the contents or security of any such third party websites.

7. Limitations of Liability

7.1 This Site is provided “AS IS” and “AS AVAILABLE” for your personal use only. We do not guarantee or make any promise that this Site, or any content on it, will always be available, uninterrupted or error or bug/virus free, secure, reliable or fully functioning. We may suspend or withdraw or restrict the availability of all or any part of it for any reason at any time without notice. In addition, we make no warranties, whether express or implied, in relation to the accuracy or usefulness to you of the Site or any of its content. We will not be responsible or liable to you for any loss of content or material as a result of uploading to or downloading from the Site.

7.2 We shall not be liable to you or any other party in contract or tort (including without limitation negligence) whether directly or indirectly for: (i) any economic losses including loss of revenues, profits, contracts, business or anticipated savings or wasted costs; (ii) any loss of goodwill or reputation; (iii) loss of data or use of data; or (iv) any special or indirect losses howsoever arising; and in any case whether or not any such losses under the above heads were within the contemplation of either of us at the date on which the event giving rise to the loss occurred.

7.3 Nothing in these Site Terms shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our officers, employees, contractors or agents; fraud or fraudulent misrepresentation or any other liability that cannot be excluded by law.

8. Indemnity

YOU AGREE TO BE FULLY RESPONSIBLE FOR (AND FULLY INDEMNITY US ON DEMAND AGAINST) ANY CLAIM, LIABILITY, DAMAGES, LOSSES, COSTS AND EXPENSES, INCLUDING LEGAL FEES, SUFFERED BY US AND ARISING OUT OF (I) ANY BREACH OF THESE TERMS BY YOU; OR (II) ANY OTHER LIABILITIES INCURRED BY US ARISING OUT OF YOUR USE OF THE SITE (INCLUDING ANY SUBMISSION BY YOU OF UGC).

9. General

9.1 If any part of the Site Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Site Terms and shall not affect the validity and enforceability of any of the remaining provisions of them.

9.2 These Site Terms (as amended from time to time) contain the entire agreement and understanding between us in respect of all matters which are referred to herein and supersede any prior written or oral agreement between us relating to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Site Terms. Without prejudice to section 6.3 above, you confirm that, in agreeing to accept these Site Terms, you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Site Terms.

9.3 These Site Terms shall be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute.

B. Three Music Privacy Policy

1. Parties

We act as the "Data Controller" of the information you provide to us or that we know about you through your use of this Site for the purposes of data protection law. This Site is hosted on behalf of us by Evisua Ltd (trading as NeverBland), Unit 3, 1st Floor, 67-70 Charlotte Road, London, EC2A 3PE and operated via its partner Vercel Inc., a Delaware corporation located at 440N Barranca Ave #4133, Covina. CA 91723.

This privacy policy (the “Privacy Policy”) should be read in conjunction with the Site Terms (as set out above).
